GENERAL TERMS AND CONDITIONS OF SALE (GTCS)
PREAMBLE: PROTECTION OF MINORS
In accordance with article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under eighteen (18) years of age is prohibited. By checking the mandatory box before validating their order on the website, the customer agrees to be of legal age at the date of the order. Alcohol abuse is dangerous for your health; consume in moderation.
ARTICLE 1 – LEGAL INFORMATION AND SCOPE OF APPLICATION
These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between:
- The Seller: The company EARL NADINE FERRAND (operating Domaine Nadine Ferrand), with a capital of €30,000, registered with the Mâcon Trade and Companies Register (RCS) under number 419 314 513 (SIRET: 41931451300021). The registered office and tasting cellar are located at 51 Chemin du Voisinet, 71850 Charnay-lès-Mâcon.

- The Client: Any individual or legal entity making a product purchase or booking a service on the Domaine's website.
The Client acknowledges having read and accepted these GTCS without reservation before validating their order. The applicable GTCS are those in force on the date of the order.
ARTICLE 2 – PRODUCTS, OFFERS AND STOCK MANAGEMENT
Products (Domaine wines, regional products) and services (oenological workshops, tastings) are presented on the website with the greatest possible accuracy.
Product and price offers are valid while stocks last. As wine is a product subject to the vagaries of harvests, in the event of a stockout of a given vintage after an order has been validated, EARL NADINE FERRAND undertakes to inform the Client as soon as possible. The Client may be offered:
- The shipment of the same wine from an equivalent vintage in terms of quality and price.
- A refund for the unavailable bottle or the entire order, according to the Client's choice.
ARTICLE 3 – PRICES, PACKAGING AND PAYMENT
The prices displayed on the website [https://www.ferrand-pouilly-fuisse.com/](https://www.ferrand-pouilly-fuisse.com/) are indicated in Euros (€) All Taxes Included (TTC), including the French VAT at the legal rate in force as well as the excise duties applicable to alcohol.
Packaging and Shipping Costs:
Product prices do not include shipping and delivery costs. Delivery costs are calculated automatically based on the chosen transport method (Relais, Express, Home Delivery), the total weight of the order, and the destination. The transport costs displayed before the final order validation include the flat rate cost of high-resistance secure packaging (reinforced cartons approved for wine bottle transport).
Full payment is due upon order by credit card (via a secure payment system) or by any other payment method available on the website.
ARTICLE 4 – TASTING SERVICES AND WORKSHOPS AT THE
CELLAR
EARL NADINE FERRAND offers online booking of reception, tasting, and oenological workshop services at its cellar in Charnay-lès-Mâcon.
- Modification or cancellation by the Client: Any request for cancellation or postponement by the Client must be notified by email or telephone at least 48 hours before the scheduled time of the service. If this 48-hour notice period is not respected, the service will be considered due and no refund or postponement can be claimed.
- Cancellation by the Domaine: EARL NADINE FERRAND reserves the right to cancel or postpone a service in case of force majeure or if the required minimum number of participants is not reached. In this situation, the Client will be fully refunded or may choose a new date, without being entitled to additional compensation.
ARTICLE 5 – RIGHT OF WITHDRAWAL (HAMON LAW)
The applicable right of withdrawal depends strictly on the nature of the order:
- Wines and non-perishable items: The Client has a legal period of fourteen (14) calendar days from receipt of their goods to exercise their right of withdrawal without stating a reason. Return shipping costs are the sole responsibility of the Client. Bottles must be returned sealed, intact, unaltered, and in their original secure packaging to the registered office address.
- Perishable regional products: In accordance with article L. 221-28 of the Consumer Code, the right of withdrawal is expressly excluded for the supply of goods liable to deteriorate or expire rapidly. No fresh or perishable local products will be taken back or refunded.
- Dated tasting services: In accordance with article L. 221-28 12° of the Consumer Code, the right of withdrawal does not apply to leisure activity services that must be provided on a specific date or period. Online tasting reservations are therefore not subject to any right of withdrawal.
ARTICLE 6 – SHIPPING, DELIVERY AND BREAKAGE IN TRANSIT
Products are shipped to the delivery address or relay point selected by the Client when placing their order. EARL NADINE FERRAND retains exclusive ownership of the goods until full payment of the price (retention of title clause). However, the transfer of risks of loss or damage to the products occurs when the Client (or a third party designated by them) physically takes possession of the parcels.
Delivery methods: Shipments are made via our specialized transport partners (Chronopost / Chrono Viti, UPS). Average indicative delivery times are presented when choosing the carrier.
Verification Obligation and Claims (Breakage) : The Client is obliged to check the condition of the packaging and the number of parcels in the presence of the delivery person or the relay point merchant.
o In case of a broken or missing bottle, or damaged packaging, the Client must imperatively refuse the parcel or make clear, precise, and dated handwritten reservations on the electronic or paper delivery note (e.g., "Damaged carton, 2 broken bottles inside").
o The Client must inform EARL NADINE FERRAND by e-mail (contact@domaineferrand.fr) within 48 hours, attaching photographs of the carton and damages if possible. The Domaine will then proceed with the re-shipment of the damaged bottles or their refund without additional cost to the Client.
ARTICLE 7 – LEGAL GUARANTEES AND CORK TAINT
EARL NADINE FERRAND guarantees the conformity of the goods sold under the legal guarantee of conformity (articles L. 217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
Specific case of cork taint: If a bottle of Domaine wine shows clear cork taint, the Client is invited to contact the Domaine by e-mail. To obtain a replacement or refund, the Client must imperatively return the offending bottle almost full (containing at least 3/4 of the original volume) and re-corked with its original cork. Re-shipping costs will be covered by the Domaine if the defect is validated after technical expertise.
ARTICLE 8 – PERSONAL DATA (GDPR)
Personal data collected on the site is necessary for invoicing, preparing, and delivering orders (mandatory transmission of email and telephone contact details to carriers for tracking and customs clearance). This data is processed confidentially in accordance with the General Data Protection Regulation (GDPR). The Client has a permanent right to access, rectify, object to, and delete their personal data, which they can exercise by writing to: contact@domaineferrand.fr.
ARTICLE 9 – DISPUTES AND MEDIATION
These GTCS are governed by French law. In the event of a complaint, the Client should first contact EARL NADINE FERRAND to find an amicable agreement.
Any dispute that cannot be resolved amicably or through mediation will be submitted to the competent French courts.
